Health care ruling gives GOP new attack line

(CNN) -

Taxes took center stage in renewed Republican attacks on the Obama administration's sweeping health care legislation Thursday after the Supreme Court rebuffed attempts to derail it based on its constitutionality.

Using the court's finding that the centerpiece of the law -- the individual mandate -- amounted to a legal exercise of congressional tax power became Plan B for the GOP.

"That's not what the president said when he introduced the bill, but what the court said was that it's OK because it's a tax," U.S. Rep. Tom Price, R-Ga., told CNN. "The debate that we're happy to have is that our friends on the other side of the aisle (not only) want to tax what you do, they want to tax even what you don't do."

And Florida Republican Sen. Marco Rubio said, "Millions of Americans may now have a IRS problem as a result of the ruling."

But Lawrence Jacobs, a leading chronicler of the battle over health care, says that shouldn't be a surprise.

The requirement that all adults have health coverage is the linchpin of the Patient Protection and Affordable Care Act, the health care legislation President Barack Obama signed in 2010 after an epic brawl in Congress. That rule survived its last legal challenge Thursday when the Supreme Court ruled it was constitutional under the legislative branch's power to impose taxes.

Obama had denied the mandate was a tax during a 2009 interview with ABC, comparing it to state requirements that motorists carry auto insurance.

"Nobody considers that a tax increase. People say to themselves, 'that is a fair way to make sure that if you hit my car, that I'm not covering all the costs.' "

At least four million people are expected to pay a tax penalty when the rule takes full effect in 2016, bringing in about $54 billion to help offset the $1.7 trillion, 10-year cost of the act, according to the nonpartisan Congressional Budget Office. But it's only one of several revenue-raising provisions that help pay for the costs of the act, commonly dubbed "Obamacare."

"This was the Democratic tax bill," said Jacobs, a University of Minnesota political scientist and co-author of a 2010 book on the health care battle.

In addition to the mandate, there is a higher Medicare tax rate on taxpayers making more than $200,000 a year or $250,000 for married couples, and it added a tax on investment income to fund the federal health program for seniors.

"It's one of those invisible things, and it's very important," Jacobs said.

There's also an excise tax on so-called "Cadillac" health plans, which had been hotly debated at the time; a higher threshold on medical deductions; and a 10 percent excise tax on indoor tanning services. But while Republicans have long opposed higher taxes, Jacobs said they concentrated their fire on the mandate instead.

"Rather than getting into a convoluted conversation about taxes that were pretty obscure to most people, they latched onto the individual mandate," he said. "Now that the Supreme Court has up held the mandate, it's really kind of taken the wind out of their sails."

Jacobs said most Americans will be covered by employee health plans, a head of household's employer or by existing government programs such as Medicare, Medicaid or veterans' benefits. Of the roughly 6% of the population remaining, a large portion of those will be exempted from the mandate either because of poverty, religious belief or other reasons, he said.

Google wasn't going to leave its budding social layer (don't call it a network) out of today's IO fun. It gave itself a bit of a pat on the back for (probably) exceeding people's expectations. For all the jokes that have been made (some of them on this very site) at Google+'s expense, it's racked up more than 250 million users. Sure, only 150 million actually active, but simply getting people signed up is a victory in itself. And, hey, about 50 percent of them sign on every day. More interestingly, Vic Gundotra says that more users are signing in with the mobile app than visiting the desktop site. That's great news to go along with the dedicated tablet version that was also announced.

Tests find only marijuana in face-chewer's system

MIAMI (AP) ? Lab tests detected only marijuana in the system of a Florida man shot while chewing on another man's face, the medical examiner said Wednesday, ruling out other street drugs including the components typically found in the stimulants known as "bath salts."

There has been much speculation about what drugs, if any, would lead to the bizarre behavior that authorities said Rudy Eugene exhibited before and during the gruesome attack that left the other man horribly disfigured. A Miami police union official had suggested that Eugene, who was shot and killed by an officer, was probably under the influence of bath salts.

The Miami-Dade County Medical Examiner said in a news release that the toxicology detected marijuana, but it didn't find any other street drugs, alcohol or prescription drugs. Eugene also tested negative for adulterants commonly mixed with street drugs.

The department ruled out the most common components found in so-called bath salts, which mimic the effects of cocaine or methamphetamine and have been associated with bizarre crimes in recent months. An outside forensic toxicology lab, which took a second look at the results, also confirmed the absence of bath salts, synthetic marijuana and LSD.

Messages left with the medical examiner's office for comment were not immediately returned.

The Drug Enforcement Administration last year temporarily outlawed the possession and sale of three synthetic stimulants sometimes packaged as "bath salts." Several states have also moved to ban the drugs, often sold on the Internet and in head shops and other retail outlets. The bans don't affect the kinds of bath salts added to tubs for their fragrance and cosmetic benefits.

An expert on toxicology testing said that marijuana alone wasn't likely to cause behavior as strange as Eugene's.

"The problem today is that there is an almost an infinite number of chemical substances out there that can trigger unusual behavior," said Dr. Bruce Goldberger, Professor and Director of Toxicology at the University of Florida.

Goldberger said that the medical examiner's office in Miami is known for doing thorough work and that he's confident they and the independent lab covered as much ground as possible. But it's nearly impossible for toxicology testing to keep pace with new formulations of synthetic drugs.

"There are many of these synthetic drugs that we currently don't have the methodology to test on, and that is not the fault of the toxicology lab. The challenge today for the toxicology lab is to stay on top of these new chemicals and develop methodologies for them, but it's very difficult and very expensive." Goldberger said. "There is no one test or combination of tests that can detect every possible substance out there."

An addiction expert said she wouldn't rule out marijuana causing the agitation.

"It could have been the strain of marijuana that increases the dopamine in the brain, such as sativa," said Dr. Patricia Junquera, assistant professor at the Department of Psychiatry at the University of Miami Miller School of Medicine.

There are two strains of marijuana called sativa and indica. The sativa increases dopamine and gives you energy while decreasing pain threshold. Indica is a "sleepy high," she explained.

"People don't really know what the amount of either is in each little packet of marijuana," she explained. "And we can't differentiate between the two in the blood, much less in a dead person."

She also suggested that if Eugene had a mental disorder, "the marijuana could have increased even further the dopamine levels and aggravated the situation. So that can't be ruled out."

It's not clear what led to the May 26 attack on Ronald Poppo, a 65-year-old homeless man who remains hospitalized. Eugene's friends and family have said he was religious, not violent and that he didn't drink or do drugs harder than marijuana.

"There's no answer for it, not really," Eugene's younger brother, Marckenson Charles, said in an interview. "Anybody who knew him knows this wasn't the person we knew him to be. Whatever triggered him, there is no answer for this."

Surveillance video from a nearby building shows Eugene stripping Poppo and pummeling him, before appearing to hunch over and lie on top of him. The police officer who shot Eugene to death said he growled at the officer when he told him to stop.

Charles, Eugene's brother, said the family does not plan to pursue any legal action against the police for shooting Eugene.

"They used the force they felt was necessary, even if we don't agree with that,' he said.

He said that Eugene has been buried.

Shortly before the attack, a person driving on the MacArthur Causeway told a 911 dispatcher a "completely naked man" was on top of one of the light poles on the causeway and "acting like Tarzan." Still, police have said little about what may prompted Eugene to attack Poppo.

Poppo has undergone several surgeries and remains hospitalized. His left eye was removed, but doctors said earlier this month they were trying to find a way to restore vision in his right eye. He will need more surgeries before he can explore the options for reconstructing his face, doctors have said. A message left with the hospital was not immediately returned.

Poppo's family has said it had no contact with him for more than 30 years and thought he was dead.

Eugene's girlfriend, meanwhile, has said he never showed any signs of violence. Yovonka Bryant said she and Eugene often read the Bible and the Quran together, and often watched a religious television program in the mornings. She said she never saw Eugene drink and only saw him smoke marijuana once at a party.

Court ruling offers inmates rare chance at freedom

DETROIT (AP) ? The Supreme Court ruling that banned states from imposing mandatory life sentences on juveniles offers an unexpected chance at freedom to more than 2,000 inmates who had almost no hope they would ever get out.

In more than two dozen states, lawyers can now ask for new sentences. And judges will have discretion to look beyond the crime at other factors such as a prisoner's age at the time of the offense, the person's background and perhaps evidence that an inmate has changed while incarcerated.

"The sentence may still be the same," said Lawrence Wojcik, a Chicago lawyer who co-chairs the juvenile justice committee of the American Bar Association. "But even a sentence with a chance for parole gives hope."

Virtually all of the sentences in question are for murder. When Henry Hill was an illiterate 16-year-old, he was linked to a killing at a park in Saginaw County and convicted of aiding and abetting murder.

Hill had a gun, but he was never accused of firing the fatal shot. Nonetheless, the sentence was automatic: life without parole. He's spent the last 32 years in Michigan prisons.

"I was a 16-year-old with a mentality of a 9-year-old. I didn't understand what life without parole even meant," Hill, now 48, said Tuesday in a phone interview.

He heard about the Supreme Court decision while watching TV news in his cell.

"I got up hollering and rejoicing and praising God," said Hill, who would like to renovate homes and be a mentor to children if he's released. "The last three or four years, they always put young guys in with me."

The ruling also alarmed families of crime victims. Jessica Cooper, prosecutor in Oakland County, Mich., said her office has been taking calls from "distressed" relatives.

"Now they're going to start all over," Cooper said. "It's going to take years."

The Michigan Corrections Department said 364 inmates are serving mandatory life sentences for crimes they committed before turning 18. The prisoners now range in age from 16 to 67.

In Monday's 5-4 decision, the high court said life without parole for juveniles violates the Constitution's ban against cruel and unusual punishment. More than 2,000 people are in U.S. prisons under such a sentence, according to facts agreed on by attorneys for both sides of the case.

It's possible that some inmates will win immediate release. Judges could also impose new sentences carrying a specific number of years and a parole review. Some inmates could still be kept locked up for life.

"Judges have options," said Deborah LaBelle, a lawyer in Ann Arbor, Mich. "The Supreme Court said to look at juveniles individually: their age, family background, peer pressures, home environments."

LaBelle said she took a phone call from 34-year-old inmate Kevin Boyd, who was 16 when his mother killed his father. Boyd had given her the keys to his father's apartment, was aware of her threats and was convicted of murder.

After hearing of the court's decision, Boyd told LaBelle that he slept "with hope on my pillow for the first time in 15 years."

Back in 1996, Saulo Montalvo was a 16-year-old getaway driver in a fatal store robbery in Grand Rapids. He never stepped into the store but was convicted of murder and sent away for life.

"My mom and dad had gotten divorced, and I thought I had something to do with it," he said of his teen years. "I placed this burden on myself and began to act out. I gravitated toward people who were into minor crimes, drinking and smoking marijuana, and sought their acceptance. ... I was so broken by what I had done."

He said the victim's family has long forgiven him. And if released, Montalvo said, he could "be a benefit to the society I left behind."

The judge who sentenced him, Dennis Kolenda, didn't like the punishment but had to follow the law.

"A community that's got a soul has to recognize children are different, and we need to treat them as different," said Kolenda, who is now retired. "Some are incredibly dangerous, but we never know with kids how they're going to develop."

Michigan Attorney General Bill Schuette, who supported the state's life without parole law for juveniles, said crime victims won't be forgotten during the next round of court hearings.

"Every case has its unique set of facts," Schuette said. "We're going to make sure the truth is accurate."

If the lack of constant reminders to maintain good posture has you slouching and hunching, there are countless technological substitutes. Even a few nice DIY ones. But we've got to give Ellen Sundh props for the simplicity of her solution. While similar projects rely on accelerometers, which can be difficult for the budding hobbyist to work with, to monitor the angle of your body, Bad Posture sticks with a simple bend sensor to keep tabs on your spinal cord. The flexible plastic is arranged vertically in a fabric belt that also houses an Arduino, a Wave Shield from Adafruit and a push button for calibration. MADISON -- The blood-brain barrier -- the filter that governs what can and cannot come into contact with the mammalian brain -- is a marvel of nature. It effectively separates circulating blood from the fluid that bathes the brain, and it keeps out bacteria, viruses and other agents that could damage it.

But the barrier can be disrupted by disease, stroke and multiple sclerosis, for example, and also is a big challenge for medicine, as it can be difficult or impossible to get therapeutic molecules through the barrier to treat neurological disorders.

Now, however, the blood-brain barrier may be poised to give up some of its secrets as researchers at the University of Wisconsin-Madison have created in the laboratory dish the cells that make up the brain's protective barrier. Writing in the June 24, 2012 edition of the journal Nature Biotechnology, the Wisconsin researchers describe transforming stem cells into endothelial cells with blood-brain barrier qualities.

Access to the specialized cells "has the potential to streamline drug discovery for neurological disease," says Eric Shusta, a UW-Madison professor of chemical and biological engineering and one of the senior authors of the new study. "You can look at tens of thousands of drug candidates and just ask the question if they have a chance to get into the brain. There is broad interest from the pharmaceutical industry."

The blood-brain barrier depends on the unique qualities of endothelial cells, the cells that make up the lining of blood vessels. In many parts of the body, the endothelial cells that line capillaries are spaced so that substances can pass through. But in the capillaries that lead to the brain, the endothelial cells nestle in tight formation, creating a semi-permeable barrier that allows some substances -- essential nutrients and metabolites -- access to the brain while keeping others -- pathogens and harmful chemicals -- locked out.

The cells described in the new Wisconsin study, which was led by Ethan S. Lippmann, now a postdoctoral fellow at the Wisconsin Institute for Discovery, and Samira M. Azarin, now a postdoctoral fellow at Northwestern University, exhibit both the active and passive regulatory qualities of those cells that make up the capillaries of the intact brain.

The research team coaxed both embryonic and induced pluripotent stem cells to form the endothelial cells of the blood-brain barrier. The use of induced cells, which can come from patients with specific neurological conditions, may be especially important for modeling disorders that compromise the blood-brain barrier. What's more, because the cells can be mass produced, they could be used to devise high-throughput screens for molecules that may have therapeutic value for neurological conditions or to identify existing drugs that may have neurotoxic qualities.

"The nice thing about deriving endothelial cells from induced pluripotent stem cells is that you can make disease-specific models of brain tissue that incorporate the blood-brain barrier," explains Sean Palecek, a UW-Madison professor of chemical and biological engineering and a senior author of the new report. "The cells you create will carry the genetic information of the condition you want to study."

The generation of the specialized blood-brain barrier endothelial cells, the Wisconsin researchers note, has never been done with stem cells. In addition to the potential applications to screen drugs and model pathologies of the blood-brain barrier, they may also provide a novel window for developmental biologists who are interested in how the barrier comes together and co-develops with the brain.

"Neurons develop at the same time as the endothelial cells," Shusta says, noting that, in development, the cells secrete chemical cues that help determine organ specificity.

"We don't know what all those factors are," Lippmann says. "But with this model, we can go back and look." Identifying all of the molecular factors at play as blank slate stem cells differentiate to become specialized endothelial cells could one day have clinical significance to treat stroke or tamp down the ability of brain tumors to recruit blood vessels needed to sustain cancer.

Crime ? Japan to make illegal downloading of music, videos punishable with jail terms

The government has passed a new amendment to its copyright laws, making illegal downloading punishable with jail terms for the first time.

The new law applies to those found in possession of pirated material such as music, DVDs or Blu-ray discs, and could result in fines of up to 2 million yen and sentences of up to two years in prison, according to CNET Japan.

The changes to the law bring Japan in line with the U.S., where downloading is already a criminal offense and punishments are even more severe. U.S. criminal penalties can run up to 5 years in prison or a $250,000 fine, 10 times higher than Japan.

The move has been welcomed by music industry figures, but has caused some concern among legal experts, NTV reported. The government claims the move has been introduced to protect people making music. Warner Music Japan CEO Keiichi Ishizaka has been quoted in the press as saying that he would like to see all illegal downloading eradicated.

The new amendment makes illegal downloading truly punishable for the first time. The downloading of copyrighted material without permission has been illegal in Japan since 2009, but as a civil matter, rather than a criminal one. As a result, punishments were restricted to those who uploaded pirated content. Uploaders were liable to face penalties of up to 10 years in prison or fines of as much as 10 million yen.

The bill passed the Lower House last Wednesday with little opposition, and passed the Upper House by a vote of 221 to 12, NTV reported. One of the few opponents of the bill, Takeshi Miyamoto, suggested although illegal downloading was a problem, a more effective approach to eradicating the practice would be to establish systems to efficiently remove illegal content, rather than to focus on punishment.

Meanwhile, NHK reports that some legal experts have expressed concern that the bill?s unclear wording could lead to unfair and unnecessary prosecutions. The bill says that a person who is aware that the the download or stream results in a copyright infringement can face charges. As a result, even watching a YouTube video could result in prosecution if the viewer is aware that streaming the media is illegal.

Some groups, including the Japan Federation of Bar Associations, have suggested that this may be an excessive measure in a country that still relies on the sales and rentals of physical media and has seen a relatively slow uptake of legal download services.

Upper House member Yuko Mori, another opponent of the amendment, was widely quoted in the Japanese press as saying, ?We shouldn?t risk making the general public, including young people, the subject of criminal investigations.?

The Recording Industry Association of Japan (RIAJ) said it believes the amendments are good for the industry, and that it will strive to make the public aware of the new rules and penalties, the Nikkei reported. RIAJ chairman and CEO of Sony Music Entertainment Japan Naoki Kitagawa claimed the changes would ?reduce the spread of copyright infringement activities on the Internet.?

The new law will come into effect in October.

Egypt waits for president: Islamist or army man

CAIRO (Reuters) - Egyptians were waiting for a president on Saturday, the first they have chosen themselves, and one who will either be yet another military man or an Islamist from the army's old adversary the Muslim Brotherhood.

Impatient Brotherhood supporters have been out on Cairo's Tahrir Square day and night since a call in midweek from their leaders to demand the current military rulers cancel measures they say are designed to hem in the powers of the man they believe was elected last weekend, Islamist Mohamed Morsy.

Hundreds were there on Saturday morning, chanting "Victory for Morsy!" and "Morsy, Morsy, Allahu akbar!" (God is greatest)

The party atmosphere anticipated what could be one of the most dramatic turns of events in the Middle East in decades - the emergence of an Islamist president of the biggest Arab nation.

A delay in announcing the result, said by officials to be due to dealing with appeals over local voting irregularities, has prompted Brotherhood concern that the military-led "deep state", left over when Hosni Mubarak was toppled last year, was trying to steal their victory, as it did routinely in the past.

"We want the military council to announce the real results without forgery," said Hassan Eissa, 43, an accountant from north of Cairo who was demonstrating on the square. He accused the army of reneging on promises to hand over when it dissolved the Islamist-led parliament on the eve of the presidential run-off and then took for itself legislative powers by decree.

"They have no right," Eissa said. "Egyptians shouldn't be under any kind of guardianship after the revolution."

Some officials say a result could come as early as Saturday, although electoral commission head Farouk Sultan told Reuters officials were still examining appeals and he could not say when the result would be announced.

A Morsy win would create a dramatic new configuration for Egypt's politics. Supporters of religious rule will be delighted but others, including many who fought on Tahrir Square to end dictatorship, will be anxious at what it means for minorities, women, secular values and Egypt's dealings with the West.

Violence by hardline Islamists in Tunisia, whose revolt inspired that in Egypt, has troubled many Egyptian liberals.

On Saturday, a group of liberal and leftist groups announced the formation of an alternative "civil front" and called for respect for judicial rulings.

"Those who are attacking the military council, have allied with it when their interests were in line," said Ahmed Saied, head of the liberal Free Egyptians Party.

TALKS

Senior figures from both the Supreme Council of the Armed Forces (SCAF) and the Brotherhood told Reuters they had been in discreet talks this week on political arrangements, though the army has made clear it will not go back on what critics called a "soft coup" aimed at delaying a handover to full civilian rule.

It will neither cancel the dissolution of the Islamist-led parliament nor a decree by which it reserved legislative powers for the council, curbing the president's power.

Presented with a take-it-or-leave-it choice, the Brotherhood may find a compromise to pull their protesters off the streets. Years of conflict have made it a wary organisation, and it has cooperated with the council in the 16 months since Mubarak fell.

Electoral and military officials told Reuters during the week and as late as Friday that the Brotherhood candidate had a narrow but clear lead over former general Ahmed Shafik, Mubarak's last prime minister. But nothing is certain.

One newspaper, Shorouk, headlined: "Morsy to be announced president today ... Unless."

Morsy, like Shafik, has promised to build a government that brings in people from across the political spectrum. Many of those who launched the Arab Spring uprising were dismayed when more centrist candidates, neither from the army nor the Brotherhood, were eliminated in the first round vote last month.

While some grudgingly backed Shafik to block religious rule, others half-heartedly supported Morsy to prevent what they saw as a return to the old regime. Among those protesting on Tahrir Square on Saturday, Cairo lawyer Atef Rehan said: "I'm not from the Brotherhood and I voted for Morsy only reluctantly.

"But I am here to support their demands."

A 60-year-old, U.S.-educated engineer, the bearded and bespectacled Morsy is not a familiar figure to Egyptians, some of whom ridicule him as the movement's "spare tyre" after his campaign was launched following the exclusion from the race on a technicality of a much better known leader, Khairat al-Shater.

Both sides recall the bloodshed that ravaged another North African state, Algeria, when military rulers thwarted an Islamist movement's triumph at the ballot box in the 1990s, and appear willing to renew the tentative cooperation they built up after Mubarak's overthrow and step back from an outright clash.

An Islamist insurrection in Egypt in the 1990s also cost hundreds of lives, making the Brotherhood wary of violence.

WEIGHING OPPOSITION

Delay in the final tally of votes was due to many appeals being heard by the electoral commission, officials said. But it also gave more time for talks to defuse tensions.

"There has definitely been the process involved in tallying the official vote before announcing results," a senior state official familiar with the counting process told Reuters on Friday. "But there is also the politicking behind the scenes, with each side weighing up the strength of the other.

"The Brotherhood can draw millions of disciplined supporters onto the streets and the army has a mandate to ensure order."

Discussions between generals and Islamists, whose violent confrontation has marked Egypt for decades, were assuming Morsy would win narrowly.

"We have met with them to discuss how to get out of this crisis after parliament was dissolved and the new president's powers curbed," Shater, who runs the Brotherhood's finances and strategic planning, told Reuters - although he added they were some way from reaching any kind of agreement.

"The generals feel they are the proprietors of power and have not yet reached a level of real compromise," he said.

Major General Mamdouh Shaheen, a member of SCAF, confirmed the recent meetings and repeated the army's commitment to a democratic transition. But he echoed a strong statement issued by SCAF on Friday that rejected the Brotherhood's demands.

"The constitutional decree is the exclusive authority of the military council," Shaheen told Reuters.

In a brusque statement read on state television as Egyptians were completing their Friday prayers, the generals said: "The issuance of the supplementary constitutional decree was necessitated by the needs of administering the affairs of the state during this critical period in the history of our nation."

Morsy shot back that the generals were defying the will of the people and said protests would go on. But he praised the army as "patriotic" and urged a rapid election result.

In what were menacing tones for the army's old adversary the Muslim Brotherhood, SCAF criticised its premature announcement of the election result as sowing division and said people were free to protest - but only if they did not disrupt daily life.

In a country where virtually no one can remember an election before last year that was not rigged, trust is low, not least among Brotherhood officials, many of whom, like Morsy, were jailed under Mubarak for their political activities.

The same electoral commission that handed 90 percent of a November 2010 parliamentary vote to Mubarak's supporters - a result that fuelled the protests that brought him down a few weeks later - sits in judgment on the new presidency.
