Israeli lawyer sheds some light on Australian spy mystery

JERUSALEM/CANBERRA (Reuters) - An Australian immigrant, reported to have been recruited by Israel's Mossad spy agency, was charged with grave crimes before he committed suicide in an Israeli jail, one of his lawyers said on Thursday.

The closely guarded case has raised questions in Australia and Israel about the suspected use by the Mossad of dual Australian-Israeli nationals and the circumstances behind the 2010 detention and death of 34-year-old Ben Zygier.

Israel on Wednesday broke its silence over an Australian Broadcasting Corporation (ABC) report which said that Zygier, who moved to Israel, was jailed in isolation over suspected misconduct while spying for the Mossad.

Partially lifting a gag order on the case, an Israeli court said a dual-nationality citizen had been imprisoned secretly under a false name for "security reasons", and found dead in his cell in what was eventually ruled a suicide.

Israeli criminal attorney Avigdor Feldman said he met with the man, dubbed "Prisoner X", a day before his death.

"I met with a balanced person, given the tragic outcome, who was rationally weighing his legal options," Feldman told Channel 10 Television.

He said the detainee was charged with "grave crimes" and that there were ongoing negotiations for a plea bargain. The attorney did not elaborate on the allegations, which he said the prisoner denied. Reporting in Israel on the case is still subject to strict government censorship.

The Kuwaiti newspaper Al Jarida quoted on Thursday unidentified Western sources as saying Zygier took part in the killing by a Mossad hit-team of Hamas operative Mahmoud al-Mahbouh in Dubai in 2010.

Zygier, the newspaper reported, offered Dubai information about the operation in return for the emirate's protection.

Offering a different version, Australia's Fairfax Media said Australian security officials suspected Zygier may have been about to disclose Israeli intelligence operations, including the use of fraudulent Australian passports, either to the Canberra government or to the media before his arrest.

"His interrogators told him he could expect lengthy jail- time and be ostracized from his family and the Jewish community," Feldman said. "There was no heart string they did not pull, and I suppose that ultimately brought about the tragic end."

In a separate interview Feldman appeared to inadvertently confirm the man was a Mossad spy.

"The Mossad liaison I was in touch with informed me that, unfortunately, my client was no longer alive," Feldman told Kol Barama Radio. Israel has neither denied nor confirmed that "Prisoner X" was a Mossad officer.

The jailhouse suicide of Zygier has focused attention on the agency's recruitment of foreign-born Jews who could spy under cover of their native passports.

SUSPICIONS

Australian media have reported that Zygier had been one of at least three Australian-Israeli dual nationals under investigation by the Australian Security Intelligence Organisation over suspicions of espionage for Israel.

Australia complained to Israel in 2010 after Dubai said forged Australian passports were used by the Mossad squad. Mahbouh's killers, authorities in the emirate said, also had also had British, Irish, French and German passports.

Mossad is widely reputed to have stepped up its shadow war in recent years against Iran's nuclear program, Lebanon's Hezbollah guerrillas, suspected nuclear procurement by Syria and arms smuggling to Palestinians through Dubai, Sudan and Egypt.

In an apparent reversal from previous statements, Australian Foreign minister Bob Carr said on Thursday his ministry had known about Zygier's jailing in Israel as early as February 2010. On Wednesday he said Australian diplomats in Israel only found out about the detention after his death in custody later that year.

Israel's Justice Ministry said a court has ordered an inquiry into possible negligence in Zygier's death.

Zygier, who came from a prominent Jewish family in Australia and was also known as Ben Alon and Ben Allen, was buried in Melbourne. He had been married with two young children. His relatives have declined all comment on the case.

Somali Islamists say kill soldier, delay executions

MOGADISHU (Reuters) - Somali militants linked to al Qaeda said they executed a Kenyan army private at midnight on Thursday after the expiry of an ultimatum for the release of Muslims held by Kenya on terror charges.

The al Shabaab militants, who want to impose a strict version of sharia, or Islamic law, also said they were extending the execution deadline by 72 hours for five other hostages.

The insurgents on January 23 had given Kenya a three-week deadline to free fighters held by the east African country, but Kenya refused to negotiate and said it would not meet the demand.

Prior to the ultimatum, the group had killed French hostage Denis Allex to avenge France's persecution of Muslims and its military operations against Islamists, including in Mali.

The Kenyan defence forces have said none of its soldiers was believed held by al Shabaab.

Security analysts describe al Shabaab as a declining force that no longer controls much territory in Somalia and is not a threat to the Somali government or African Union forces there, but is still capable of mounting sporadic attacks

Nairobi sent its troops across the border to pursue the rebels in October 2011 after the insurgents kidnapped Western tourists and Kenyan security forces on Kenyan soil.

The rebels said there was still a chance of securing the release of the five prisoners, who include two government workers.

"Despite the Mujahideen opening the doors of negotiations and giving them ample time, the Kenyan government has been wilfully negligent and has failed to take adequate steps to secure the release of its citizens," the rebels said in a statement, in which they gave the executed soldier's name.

Kenya holds several suspects for alleged links with al Shabaab and extradited others to Uganda suspected of involvement in a deadly 2010 suicide bombing in Kampala, claimed by al Shabaab, that killed 76 people.

The rebels said they would give more time to the remaining hostages in response to their families' pleas.

"In 72 hours, the prisoners will either lose their lives because of their government's betrayal or celebrate their government's assistance and rejoice in their freedom," the militants said.

The militants released a video titled "KENYA POWS: FINAL MESSAGE", which showed Mule Yesse Edward, a local administrator, and Fredrick Irungu, who worked for the Kenyan ministry of immigration.

Both were captured last January when the militants crossed the border into Kenya and attacked a police post in Wajir county, killing several police officers.

The video also contained a still photograph of four unidentified prisoners whom it said were also Kenyans.

London Stock Exchange to offer growth firms their own market

LONDON (Reuters) - The London Stock Exchange is to launch a new niche market next month featuring less stringent listing terms for fast-growing companies wanting to raise funds on Britain's stock market.

The LSE's High Growth Segment market will allow medium-sized growth companies to go public with as little as 10 percent of their shares put on the market, unlike the LSE's main market where the normal minimum free float requirement is 25 percent.

Billed as a "stepping stone" to a premium listing, it fills the gap between the LSE's main market and its junior Alternative Investment Market (AIM) for small, growing companies which has no minimum requirement on how much of the company must be floated.

The High Growth Segment was developed in consultation with the British government, which has been considering easing listing rules for technology companies in particular since September to stem the flow of high-growth companies heading across the Atlantic in search of capital.

Companies keen to list must have achieved an annual revenue growth rate of at least 20 percent over a three-year period, be incorporated according to European Economic Area (EEA) regulations, publish an approved prospectus and offer a minimum of 10 percent of its shares in free float provided these shares are worth over 30 million pounds ($47 million).

To list on the main market, companies must make at least 25 percent of their shares freely available, unless a waiver is granted by the UK Listing Authority (UKLA).

In contrast to the UK, the United States provides a well-established hub for tech listings and has seen a continued flow of stock market flotations over the last year, while the UK has seen a drop in activity.

Europe has seen a slowdown in new listings generally over the last two years, as euro zone debt worries buffeted stock markets, and some technology firms, such as Edwards Group Ltd, ditched their attempts to go public in London in favour of the United States.

"By creating a segment we can build on the positive signs of market recovery in wider markets," Marcus Stuttard, the LSE's head of UK Markets told Reuters.

"Companies and advisers see this and the whole body of stakeholders and government backing equities. We are not gauging success simply on the number of companies in this segment," Stuttard said.

The announcement of the High Growth Segment coincided with the FinovateEurope event in London, a showcase of the latest products and services for the financial industry.

Exhibitor CurrencyFair, a Dublin-based money transfer service founded in 2009, said the LSE's new market segment was a tempting proposition.

"That would be very interesting," said Jonathan Potter, sales and finance director. "As long as the due diligence is straight forward and the costs of doing it are right."

However, others said a share market flotation was not always a good thing for developing companies, where companies cannot afford to take their eyes off the competition.

"You would distract so much attention from the business if you go public because you would be busy with your investors the whole time," said Conny Dorrestijn, marketing officer of Dutch banking software developer Five Degrees. ($1 = 0.6433 British pounds)

A war without end -- with Earth's carbon cycle held in the balance

The greatest battle in Earth's history has been going on for hundreds of millions of years, isn't over yet, and until now no one knew it existed, scientists reported today in the journal Nature.

In one corner is SAR11, a bacterium that's the most abundant organism in the oceans, survives where most other cells would die and plays a major role in the planet's carbon cycle. It had been theorized that SAR11 was so small and widespread that it must be invulnerable to attack.

In the other corner, and so strange looking that scientists previously didn't even recognize what they were, are "Pelagiphages," viruses now known to infect SAR11 and routinely kill millions of these cells every second. And how this fight turns out is of more than casual interest, because SAR11 has a huge effect on the amount of carbon dioxide that enters the atmosphere, and the overall biology of the oceans.

"There's a war going on in our oceans, a huge war, and we never even saw it," said Stephen Giovannoni, a professor of microbiology at Oregon State University. "This is an important piece of the puzzle in how carbon is stored or released in the sea."

Researchers from OSU, the University of Arizona and other institutions today outlined the discovery of this ongoing conflict, and its implications for the biology and function of ocean processes. The findings disprove the theory that SAR11 cells are immune to viral predation, researchers said.

"In general, every living cell is vulnerable to viral infection," said Giovannoni, who first discovered SAR11 in 1990. "What has been so puzzling about SAR11 was its sheer abundance, there was simply so much of it that some scientists believed it must not get attacked by viruses."

What the new research shows, Giovannoni said, is that SAR11 is competitive, good at scavenging organic carbon, and effective at changing to avoid infection. Because of that, it thrives and persists in abundance even though it's constantly being killed by the new viruses that have been discovered.

The discovery of the Pelagiphage viral families was made by Yanlin Zhao, Michael Schwalbach and Ben Temperton, postdoctoral researchers working with Giovannoni. They used traditional research methods, growing cells and viruses from nature in a laboratory, instead of sequencing DNA from nature. The new viruses were so unique that computers could not recognize the virus DNA.

"The viruses themselves, of course, appear to be just as abundant as SAR11," Giovannoni said. "Our colleagues at the University of Arizona demonstrated this with new technologies they developed for measuring viral diversity."

SAR11 has several unique characteristics, including the smallest known genetic structure of any independent cell. Through sheer numbers, this microbe has a huge role in consuming organic carbon, which it uses to generate energy while producing carbon dioxide and water in the process. SAR11 recycles organic matter, providing the nutrients needed by algae to produce about half of the oxygen that enters Earth's atmosphere every day.

This carbon cycle ultimately affects all plant and animal life on Earth.

Surveillance footage shows Drexel arriving at the resort, then leaving roughly 10 minutes later. What happened to her after that remains a mystery. Her cell phone gave off its last signal the day after she went missing. Investigators narrowed the phone location to an area near the South Santee River in Georgetown County. To date, no sign of Drexel has been found. At the time of her disappearance, Drexel was 5 feet tall and 103 pounds. She had blue eyes and blond highlights in her hair. Dwight Stallings, 1, has been missing from Elk Grove, Calif., since April 2011. Authorities say the child has not been seen by family members and his mother, Tanisha Edwards, 35, has been unable or unwilling to reveal what happened to him. A $3,000 reward is being offered for information leading to the whereabouts of Dwight Stallings. Etan Patz

Etan Patz, 6, who went missing on May 25, 1979, near his home in New York's SoHo neighborhood, appears in this undated file photo. In June 2001, a New York State judge declared Etan legally dead, clearing the way for his parents, Stanley and Julie Patz, to file a wrongful death lawsuit against Jose Antonio Ramos, a Pennsylvania inmate whom the family believes sexually molested and then killed Etan. His parents were eventually awarded a "symbolic" sum of $2 million. Ramos is presently serving a 20-year sentence for child molestation and is scheduled to be released in November 7, 2012.

Malikah Beeks, 17, of Cleveland Heights, Ohio, was last seen on April 11, 2012. Beeks is a possible runaway and may be with her 14-month-old son, Logan Beeks. Ayla Reynolds

Police in Maine are appealing to the public for help in locating the 20-month-old girl who was last seen Friday night. Waterville Police Chief Joseph Massey held a news conference this afternoon to ask anyone with information about Ayla Reynolds to call police. Ayla's father called police yesterday morning to report that his daughter was not in her bed and couldn't be found. She was last seen sleeping at about 10 p.m. Friday by a family member.

Nadaysia McWhite

Nadaysia McWhite, 16, was last seen leaving her home in Queens Village, N.Y., on Feb. 19, 2012. McWhite never returned home and her whereabouts remain unknown. She was last seen wearing black pants, a black hooded coat and black boots. Kyron Horman

Kyron Horman was 7 years old when he disappeared on June 4, 2010. His stepmother, Terri Moulton Horman, told police she last saw the little boy walking to his classroom at Skyline Elementary School in Portland, Ore. The search for Kyron has become one of the most intense in recent Oregon history and has attracted national attention. His parents have held countless vigils, passed out thousands of fliers and issued numerous public pleas, all to no avail.

Reyna Guadarrama

Reyna Guadarrama, 9, was last seen in Grayslake, Ill., on Nov. 02, 2007. She may be in the company of her non-custodial mother and an adult male. They may travel to Mexico. Hailey Dunn

Hailey Dunn, a cheerleader, was last seen in Colorado City, Texas, just after Christmas Day in 2010. Dunn's mother, Billie Dunn, 34, reported her 13-year-old daughter missing on the morning of Dec. 28, 2010. The Colorado City Middle School student had been last seen the previous afternoon. Billie Dunn's then-boyfriend, Shawn Adkins, 25, told police that the teen was going to spend the night with a friend. That friend later told police that she had not made any plans for Hailey Dunn to spend the night and was unaware that the girl was coming over. Billie Dunn later told police she had fought with her daughter before she went missing. Colorado City Police, along with the Texas Rangers, the Mitchell County Sheriff's Office and other law enforcement departments in the region, conducted several searches for Dunn but found no sign of her.

Maayimuna Nyeeleni Njayi N'Diaye

Maayimuna Nyeeleni Njayi N'Diaye, 4, was last seen in Morehead, Ky., on Jan. 1, 2012. Maayimuna was allegedly abducted by her father, Ibrahim N'Diaye. A felony warrant was issued for him on Jan. 13, 2012. They are believed to be in Mali.

Haleigh Cummings

This photo released by the Putnam County Sheriff's Office shows Haleigh Cummings, 5, of Satsuma, Fla. Haleigh was last seen at home in the early-morning hours of Feb. 10, 2009. She was reported missing about 3:45 a.m. by Misty Croslin, the then-girlfriend of Haleigh's father, Ronald Cummings. Croslin told police she discovered Haleigh was missing when she woke up to use the bathroom. Law enforcement as well as private search-and-recovery groups have conducted multiple searches for Haleigh, but no sign of her has been found. Authorities have not named any suspects in the case; however, they say they have not ruled anyone out.

Kaylee Melara

Kaylee Melara, 17, was last seen in Braintree, Mass., on Jan. 14, 2011. Melara is biracial and has a tattoo on her upper right arm. Worldwide mobile phone sales fell in 2012: Gartner

LONDON (Reuters) - Sales of mobile phones around the world fell last year for the first time since 2009 as consumers shunned cheaper feature phones, research company Gartner said on Wednesday.

"Tough economic conditions, shifting consumer preferences, and intense market competition weakened the worldwide mobile phone market," Gartner analyst Anshul Gupta said on Wednesday.

Smartphone sales, a category dominated by Samsung and Apple , continued to rise, he said, and the higher-end devices would account for more than half the market for the first time this year.

Total worldwide mobile sales to end users fell 1.7 percent to 1.75 billion units in 2012, Gartner said. Samsung and Apple continued to dominate the market, with the Korean company selling 385 million phones in 2012, of which 53.5 percent were smartphones, with Apple selling 130 million smartphones.

In the fourth quarter alone, Apple and Samsung accounted for 52 percent of smartphone sales, up from 46 percent in the third quarter.

Chinese company Huawei reached third spot in worldwide smartphone sales for the first time in the fourth quarter, Gartner said. It sold 27.2 million smartphones to end users in 2012, up 74 percent.
